Policies

In order to avoid fraud, only make prepayments (reservations or deposits) using a credit card (or any other card that does not require a PIN number for online purchases) or PayPal. Never make an advanced payment using cash, checks, money orders or bank transfers. Learn why.

Bookings & Deposits

- All bookings require a 1/2 deposit in order to confirm the booking.
- The outstanding balance is payable 14 days prior to arrival.
- NOTE: If any of the above payments are not received by the required time, the booking may be cancelled and a cancellation fee of $100.00 will apply.

Holiday Letting Bond:

Cape Heritage requires a holiday letting security bond of $500.00, payable 2 weeks prior to arrival, by cheque or direct deposit into the Cape Heritage bank account. This sum is then repaid by direct deposit into your bank account or by cheque within 5 working days of departure, following an inspection, provided the property is left in the same condition as at the start of the occupancy. This holiday letting bond is designed to cover any missing or damaged items, and any extra cleaning of the property that may be required, following your departure. The security deposit of $500.00 is held until the tenancy is completed.

Cancellations:

All refunded deposits are subject to an administration fee of 12% of the deposit paid (minimum $100.00).

Christmas, New Year and Easter School Holiday Periods:

Your deposit is refundable (subject to the above-stated cancellation fee) only if:
a) 4 months’ notice is given of cancellation or part-cancellation and
b) The accommodation is re-booked by Cape Heritage for the same period and value of the booking.

All other times:

Your deposit is refundable (subject to the above-stated cancellation fee) only if:
a) One month’s notice is given of cancellation or part cancellation and
b) The accommodation is re-booked by Cape Heritage for the same period and value of the booking.

When booking this vacation rental, travellers will be required to accept the terms and conditions of a booking agreement in addition to the prepayment and cancellation policies shown above. To see the agreement, click here.

Check in and check out conditions:
- Check-in time is 2pm.
- Check-out time must be 10 am, to allow for cleaning.
- A $50.00 per hour penalty fee may be charged for late checkouts.
- Make sure all garbage is in the outside bin provided and the property is left in the condition in which you found it.
- You are responsible for the removal of any extra rubbish over and above the norm. Please be considerate. Extra charges may apply for removal of excess rubbish.

Cleaning:
If Cape Heritage requires substantial extra cleaning, there may be an additional fee. The BBQ is provided for you’re enjoyment, please leave it clean or you may be charged $50 extra for cleaning. You are responsible for any damage to the property and its contents.

Please assist by leaving the premises clean and tidy, with cutlery, cooking utensils and dishes etc. washed and put away, or additional cleaning fees may be deducted from the security deposit. If, in the unlikely event that the property or contents fail to meet acceptable standards upon your arrival, every endeavour will be made to rectify the problem, however this shall not constitute grounds for cancellation or refund.


Keys:
Unless otherwise arranged, keys are available from the owners on your arrival at your accommodation at Cape Heritage.

Number of Persons:
The number of persons specified on page 1 of this form is the maximum number permissible at the rates quoted. Any increase in numbers must be agreed in advance. Each extra guest above the number booked will be charged an extra tariff EQUIVALENT TO THE PER PERSON DAILY RENTAL AT THAT TIME OF YEAR. Please bear in mind that the recommended maximum number of guests is no more than 8, to ensure the comfort of all staying at Cape Heritage and that the property’s facilities are not overloaded.

Property Use:
The property is to be used for short-term residential accommodation only. The property is not to be used for any commercial activity, wedding, party, gathering or any other function unless specifically agreed with the owners beforehand. This condition is imposed by Byron Shire Council and applies to all holiday properties in the shire.

Smoking:

- Please do not smoke inside the house.
- Ashtrays are provided for smoking outside.
- If it is necessary to have the curtains/chair covers dry-cleaned, a surcharge will be levied.
- At no time are cigarette butts to be discarded in the gardens, on paths, at the pool or on the driveway.
- Please dispose of butts in the ashtrays or put them in the garbage.

Noise:
Please remember that this is a peaceful residential area. Therefore, there must not be any noise or behaviour, which is unacceptable to our neighbours day or night. No disrupting noise of any kind is permissible between 10pm to 7am. Please clear decks and pools between 8pm and 8am. (For the avoidance of doubt: Noise means any sound that can be heard from neighbouring properties, which disturbs their peace and quiet.)

It is therefore essential to be considerate of our neighbours on arrivals and departures throughout your stay. Guests need to be aware that we do hire a security company to look after our property. Should we receive a complaint about excessive noise or anti social behaviour, a security company may be called to investigate, incurring a charge of $100.00 per call out. A second visit could result in eviction without refund. (Please also see page 5 of this document ‘Byron residential areas – the quiet environment’).

Garbage:
Garbage is to be put in plastic bags and then into the bins provided. Recyclable rubbish and garbage must be placed separately in appropriate bins: Yellow bin for recyclables and Red bin for all other rubbish. Bin lids must close snugly. Arrangements must be made to dispose of all garbage and recyclable rubbish that will not fit in bins provided. No surplus rubbish is to be placed in the street. Please observe recycling practices where possible.

Pets:
In consideration of the wildlife in the vicinity, pets are not allowed at Cape Heritage. Our local fauna includes koalas, possums, lizards, wallabies, echidnas, and a variety of very friendly native birds.

Key return and lost keys:
- On final departure, keys must be left under the front door.
- In the case of lost keys, please phone the owners on 0411 705313 or 66 855325.
- A fee of $50.00 will be charged for lost or unreturned keys.

Personal property:
The owners take no responsibility for the loss of tenants’ personal property or injury.

Changes to the property:
The owners of Cape Heritage reserve the right to change anything on the property, including significant renovations or changes of land use. Should changes occur between the time of booking and the time of arrival, guests will be notified in advance.

Onsite management:
On site management includes pool care, garden and property maintenance and added security. The entire property consists of 2 acres with Cape Heritage being the main house. The owners, John and Rago Dahlsen, also live in a self-contained separate cottage within the two-acre site. However, please be assured that they appreciate their privacy just as much as you do. The Byron Bay Health Retreat is also situated on the site, away from the house and is available for your discounted use and enjoyment during your stay.

Breaches of conditions:
While it is an extremely rare event, the Cape Heritage owners reserve the right to evict tenants, thereby forfeiting rental and security deposit payments, if there are serious breaches of any of these booking conditions.

Payment of holiday rental fees constitutes acceptance of all the above conditions.

We aim to make your holiday experience as pleasant as possible, however the responsibility does rest with you to make the relevant enquiries to ensure our premises is suitable for your needs.

Byron residential areas - The Quiet Environment
You will have noticed in our advertising that one of the best things about our property is its quiet environment. You are privileged to be able to enjoy a peaceful holiday in a residential area. This can only be achieved if the neighbourhood is aware of all the things that can allow noise to escape from each household. During the day the ambient noise level is naturally higher than at night when activity is reduced or ceased when people start to sleep. Due to the natural acoustics of this area noise travels with surprising clarity and distance. Thus conversations on the verandahs are very likely to be broadcast clearly, especially in the evenings.
(“Clearing the decks” between 10pm and 7am is the agreed neighbourhood policy.)
If returning from a night out in town, please be doubly sure that you don’t disturb people. One past problem has been with taxis either at the bottom of the driveway or driving up to the house. Please pay the driver before opening the door and then exit as quietly as possible. You would probably be amazed at how much noise can come from a group getting out of a taxi or car, especially if the vehicle has a sliding door and if animated conversations are continued.

Perhaps one of the most distressing sources of noise is from music. Obviously music that carries to another dwelling can be a massive invasion of privacy. However what is not so evident is the fact that bass frequencies pervade even at low volumes. A lot of current popular music relies heavily on the bass frequencies. The resonance that occurs is often louder inside neighbouring dwellings than outside. “Doof” types of music are guaranteed to send the neighbourhood crazy.

If you can hear your music whilst on the verandah, so can your neighbours. We ask that you be aware of the level of noise escaping from the property at all times of the day and night, so that the quiet ambience is protected for everyone’s enjoyment including your own.

Byron Council by-laws insist that NO noise can be heard from another property at night and NO excessive noise at any other times. In addition to our security service charges, the Council can take action against any noise complaint with fines of between $220 and $3000: furthermore, police can also issue noise abatement orders of $220 for each transgression.
