The Villas at Poipu Kai welcome you as our guests on the beautiful island of Kaua`i. This document serves as formal confirmation for your reservation as well as your rental contract. Please read through this document carefully and call us at 866-362-4755 with any questions you may have. After reading this confirmation contract, you must do one of the following to secure your reservation:
Save the email to your computer. Type in the names and ages of those staying in your Villa. On the signature lines, type in your name. Then just send the document back to reservations@villasatpoipukai.com.

Print out this document and sign the contract on the two signature lines, and return via fax to 866-980-8040 or +1-435-752-5929 from outside the United States. This contract is effective from the time of booking until your stay is completed.
Rental Contract for at the Villas at Poipu Kai.
1. Deposit (or Full Payment): A deposit of $1,000, is due at time of booking for all reservations made more than 60 days (90 days Holiday reservations ) prior to check-in. If at the time of reservation there is less than 60 days (90 days Holiday reservations) before your check-in date, the full rental amount (via credit card) is due in full. This amount is subject to the same terms as the deposit. If a deposit, or full amount (if required), is not given at the time of booking, or if your credit card is denied, your reservation will not be confirmed.
2. Rental Balance Payment: The remaining total rental amount, which includes: rent (minus the security deposit) additional fees (if applicable) taxes and cleaning fee is due 60 days (90 days for Holiday reservations) prior to your arrival. By default, the amount will be automatically be charged, without notification, to the same credit card used for the deposit. If you wish to pay this amount by check, or on a different credit card, arrangements must be made at least 65 days (90 days for Holiday reservations) prior to your arrival. In the event that your reservation is made within 60 days (90 days for Holiday reservations) of arrival, the entire amount is due at the time of booking.
3. Cancellation Policy: Any cancellation made between the time of booking and 60 days (90 days Holiday reservations) prior to your arrival will result in a refund of all monies paid.
Any cancellation (partial or full), change of dates, or early departure made less than 60 days (90 days Holiday reservations) prior to your contracted arrival date and the time of departure will result in forfeiture of all monies paid, or the option to apply the monies toward a future stay. If The Villas at Poipu Kai is able to re-book your Villa, you will receive a refund equal to the monies received from the re-booking. IF THE VILLA IS NOT RE-BOOKED, THERE WILL BE A FORFEITURE OF ALL MONIES PAID, or you may apply monies collected to a future stay for emergency cancellations. The Villas at Poipu Kai will make its best efforts to re-book the Villa but both The Villas at Poipu Kai and you acknowledge that such re-bookings are not always successful and not always for the same number of nights as your original contract.
4. Additional Guest Charge: This contract allows for adults and children to be in residence of the Villa during your rental period. If you exceed the maximum capacity of your unit by having more guests than the contracted amount states above, a fee of $50 per person per night will be added to your invoice and charged to your credit card. In addition, upon such violation, The Villas at Poipu Kai reserves the right to terminate the reservation for any of the remaining nights left on the contract.

GUEST POLICIES:
You, as the Renter, agree that you can be charged for any damage, missing items, or extraordinary cleaning costs caused by you during your stay. These items are considered as, but not limited to, the following: extraordinary wear and tear, upholstery and/or carpet damage or stains, sand in the washer or dryer units, structural damage to the Villa and/or its contents. These damages will be charged to the renters’ credit card on file with The Villas at Poipu Kai.
6. Lost Key Charge: If the pool keys are lost, the renter will be charged a replacement fee of $50.
7. Disclaimer of Liability: The Villas at Poipu Kai will not be responsible in any way for loss or damage to any article belonging to guest located in said premises. The Villas at Poipu Kai will also not be liable in any way for personal injuries of any kind, occurred on premises of The Villas at Poipu Kai.
8. Cleaning Fee: A cleaning fee is required in addition to the rental rate. Each rental unit is expertly cleaned prior to each guest’s arrival. This fee covers the cost of cleaning your Villa and is a standard fee throughout Kaua`i. Upon departure, if more than the normal cleaning charge (as noted under “Damage Charges”) is required to restore the Villa to its “arrival condition,” you will be charged additional cleaning fees above and beyond the cleaning fee.
Maid service or other cleaning service is not provided at The Villas at Poipu Kai during your stay without prior arrangements being made and additional fees of $45-$145 per cleaning day. This service must be arranged prior to your arrival and will be charged according to the type of service you desire.
9. NO SMOKING ANYWHERE ON THE PROPERTY - I agree to abstain from smoking in the Villa, on the Lanai, or anywhere on the Villas at Poipu Kai Property. I understand that if I do, additional fees and fines are applicable.
10. Relocation Policy: Your Villa number and location will be assigned to you in the final confirmation email, which will be sent 10 days prior to your arrival. Upon this assignment, and at any time prior to or during your stay, The Villas at Poipu Kai retains the right to relocate you in a comparable unit within the area if unforeseen circumstances should arise such as an act of terrorism, or an act of God, such as fire, which prevents The Villas at Poipu Kai from accommodating you at any of The Villas at Poipu Kai Properties units’ altogether. The Villas at Poipu Kai reserves the right to cancel your reservation with 30 days written notice. In such cases, The Villas at Poipu Kai will attempt to assist you in relocating you to a comparable resort.
The Villas at Poipu Kai does not assign guests to a specific Villa until we send the check-in information. Assignment is based upon availability. The Villas at Poipu Kai will do its best to comply with guests' requests but does not guarantee specific or requested Villas placement.
11. Check-In/Check-Out Times: Check-in is any time after 3:00 pm and check-out is at 10:00 am. These times are strictly enforced and require prior approval otherwise. Late check-out is an especially popular request as many flights departing the islands leave in the evening hours. If you require a late or early check-in/-out, you can guarantee this by reserving an additional ½ day, which is subject to additional costs and availability.
12. House Rules: While staying in your assigned Villa at The Villas at Poipu Kai, or visiting others in other Villas at The Villas at Poipu Kai, you and all guests/visitors agree to follow the listed house rules. You further agree that neglecting these rules may lead to excessive wear and tear or damage to your Villa, which you agree to pay for as previously outlined in the “Damage Charges” section.
a. Please use coasters for all cups and drinks.
b. Please confine all eating or drinking to the kitchen, dining room table or lanai only. (Any upholstery or carpet stains are subject to additional fees as stated.)
c. Please keep music, TV and other noise to a minimum. Please be mindful of others staying above or below you.
d. Please remove all sand from clothing and other items before entering your Villa. Do not sit on furniture, upholstery or beds before all sand is removed.
e. Please do not sit on furniture, upholstery or beds with wet clothing of any kind, but especially swim wear. Stains from pool chemicals, for example, tend to appear after a damaged area has dried.
f. Please wash or dry laundry that has previously been cleaned of all sand.
g. Please do not run the air conditioner while the windows are open. Choose to either open the windows or run the air conditioning.
h. Please remove shoes before entering the Villa, especially before entering carpeted areas.
i. Please use only approved cleaning products on the glass stove tops and/or the stainless steel appliance doors.
j. Please abide by the pool area rules and hours of operation.
13. Unforeseen Unit Malfunctions: During your stay, if something breaks down, such as an appliance, please contact The Villas at Poipu Kai and we will immediately try to resolve the problem. An unforeseen malfunction in your Villa does not entitle you to terminate your reservation without penalty. The Villas at Poipu Kai will do its best to remedy the situation so your stay remains enjoyable.
14. Removal of Guests Property: Guests shall remove all personal property at the time of vacating the Villa. Any and all personal property left in or about the premise and not so removed by the above-specified time shall be removed by The Villas at Poipu Kai and disposed of as provided by law without any liability to The Villas at Poipu Kai. Should you request your left items be mailed to you, we will do so with an additional mailing fee.
CONTRACT ACCEPTANCE AND RETURN:
The payment of your $1,000 deposit (or total payment if applicable) has secured your reservation. A signed copy of this contract is required to finalize your reservation. Check-in instructions will not be sent until we receive a signed contract agreeing to the above stated terms.
