Policies

In order to avoid fraud, only make prepayments (reservations or deposits) using a credit card (or any other card that does not require a PIN number for online purchases) or PayPal. Never make an advanced payment using cash, checks, money orders or bank transfers. Learn why.

Room rates do not include tax. A 10% hotel tax and 3% credit card processing fee will be added to final bill.
Guarantee/deposit policy:100% of cost of stay and tax will be secured against the credit card upon completion of booking and signing of usage agreement by Licensee. All payments are non-refundable.

Cancellation/No Show
unless otherwise stated in an agreement, cancelling 21 or less before arrival will result in the forfeiture of the reservation deposit. Early departure will result in the forfeiture of the remaining deposit.

I, Allen Tuller, Licensor, hereby agrees to license the use of premises at The Setai, 101 20th street, suite #________, in Miami Beach, Florida, 33139 to__________________________, licensee(s), from the dates of_________________ at 3pm until ____________ at 11am at a rate of $________ per night.
Licensee(s) agrees to make full payment before usage of premises and agrees to supply additional monies for any additional usage of premises before extension of license for use.
Any legal disputes arising for any reason in connection with this License will be disputed in Dade County, Florida, and Licensee(s) will be responsible for all legal fees in connection with any lawsuit.
Lost room keys are charged $100 per key. (Sorry, but this is what we are charged from the hotel to replace keys)
Licensee(s) indemnifies Licensor and Unit Owner(s) for any and all personal Liability with connection to this License for use. Any and all property damages caused by Licensee(s) and/or guest(s) of Licensee(s) will be the full responsibility of the Licensee(s) and such Licensee(s) will replace or pay full cost of replacing any damaged items. The credit card on file will be used as security against damages.
No smoking inside the suite. Smoking is permitted outside on the balcony. Any cost involved with removal of any smoke damage inside the suite will be paid by Licensee.

Waiver of Claims and Indemnity.  Licensee releases Licensor, Unit Owner(s), Licensor’s agents, contractors and employees from, and waives all claims for death, injury, loss or damage to person(s) or property sustained by Licensee or by any other person within or beyond the Licensed Space, resulting directly or indirectly, or in any way attributable to the use or occupancy of the Licensed Space. Licensee shall defend, indemnify and hold Licensor, and Licensor’s agents, contractors and employees, harmless from and against all claims, actions and liabilities, including reasonable attorneys’ fees, for death or injuries to all persons and damage to or loss of property occurring in or about the Licensed Space.
